"After a considerable amount of negotiation,

the owners have practically agreed to the following terms,

which I now submit for favourable consideration:-

the areas and laying out of the lots to be as shown on the enclosed tracing, marked 'A'.

The sea-wall and embankment between the points A and C on tracing 'A' to be constructed by the owners of the lots at their own expense and the whole of the areas tinted pink and brown to be reclaimed and filled in by them to a level of 12 to 13 fest above Ordnance Datum. The whole of the work to be carried out in accordance with plans approved by the Director of Public Works.

The sea-wall between the points A and E on tracing'A' to be constructed by the Government and the whole of the area tinted and cross-hatch- ed blue to be reclaimed and filled in by it at the same time as the adjoining work is in pro- gress and to be completed by the same date.

The time for fulfilment of the Conditions of Sale to be extended to the 31st. December, 1904.

The Government to undertake to provide, in the future laying out of the district, for a road at least 60 feet in width along the Eastern boundary. of the most Easterly lots.

No premium to be paid for the additional area included in the laying out of the lots now shown amounting to 18,400 Square Feet, but additional Crown Reat to be paid pro rata with the area originally sold. The additional Crown Rent to commence from the date of the approval of the Government being communicated to the owners.

In the event of houses being erected on the lot marked 'X' on tracing in such a manner as to require the provision of a scavenging lane under Section 180 of Ordinance 1 of 1908, such lane
